My mother (48) spent 11 years battling Lung Cancer and the entire time maintained her employment. (23 years) Around the end of may this year, excuse my language but we know who it was, a piece of human garbage for the first time, a new assistant manager, filed a complaint against her usage of time off using her FMLA. An investigation was opened to determine if she was abusing it and so she decided to leave her job under the pressure and it wasn't right for her force them to hold the position. She was officially considered terminated April 6th, and very shortly after she passed on April 29th around 11:30 PM. This cost her her benefits and life insurance from my understanding as it was employer provided. (1 year salary) This feels like an injustice and I want to know if there is anything I can do.

I am so sorry for your loss. Sounds like a really bad and stressful experience.

I would suggest you contact a lawyer to understand, whether you have a case against the previous employee - either for wrongful termination of your mother or a consequence of the loss of benefits.

At this point in time, however unjust and frustrated you may feel, this is a legal matter, and a lawyer is your best bet to understand, if it is worth your while to pursue this.
